## Seven Year Rule: Make Employee Records Audit Ready in Australia

Employers must make and keep specified employee records under the [Fair Work Act 2009 s535](https://www5.austlii.edu.au/au/legis/cth/consol_act/fwa2009114/s535.html), generally for seven years, covering personal details, hours, pay and leave. Many tax and superannuation records only need five years under Australian Taxation Office rules, but when the two overlap, seven years is the safer default. Every record must be legible, written in English, and ready to hand over if a Fair Work inspector asks. Single Touch Payroll reporting doesn’t replace this paperwork. Check today that your system can export time, wage and entitlement breakdowns on demand.

> **TL;DR:**
>
> - Employee records must be kept for at least seven years under the Fair Work Act, including detailed personal, wages, leave, and entitlement documentation.
> - Records need to be legible, in English, and easily accessible, with a clear calculation trail rather than reconstructed data after the fact.
> - Supporting documentation for payroll, PAYG, superannuation, and STP submissions must be retained for five to seven years, depending on the record type.
> - Failing to maintain proper records can lead to enforcement actions, with the most common issues being missing calculation bases, late payslips, or non-contemporaneous records.
> - Implementing a digital HR system that timestamps entries, restricts access, and allows exportable calculation trails improves compliance and audit readiness.

## What employee records you must actually keep

The [Fair Work Regulations](https://www.fairwork.gov.au/pay/pay-slips-and-record-keeping/record-keeping) set out exactly what belongs in an employee’s file, and most businesses are missing at least one category. Get familiar with the full list before an inspector does.

- **Personal and employment particulars**: full name, employer ABN, start date, employment type (casual, part time, full time) and classification under the relevant award or agreement.
- **Time and wages records**: pay rate, gross and net pay, deductions, allowances, penalty rates, and overtime start and finish times where applicable.
- **Leave and roster records**: accrued and taken leave balances, rosters, timesheets, and proof of payment for any cash wages.
- **Agreements and entitlements**: individual flexibility arrangements, averaging agreements, leave cashing-out records and termination documentation.
- **Superannuation records**: contribution dates, amounts, the receiving fund’s name, and evidence the payment actually landed.

Miss any one of these and you’ve technically breached s535, even if your payroll figures are correct.

## How long do you need to keep employee records in Australia?

Seven years is the number to remember for most employee records. Section 535 of the Fair Work Act, backed by Regulations 3.32 to 3.41, sets that period for time, wages, leave and agreement records.

The ATO runs a shorter clock for many tax and super records: five years from when the record was prepared or the transaction completed. Some records have their own start date, super guarantee contributions count from the contribution date, not the financial year end, and fringe benefits tax records run from lodgement.

- Amendment periods on tax assessments can push retention past five years.
- Some awards or enterprise agreements specify longer periods for particular entitlements.
- Company and ASIC obligations may require longer retention for certain financial records.

When in doubt, default to seven years for anything touching payroll or employment.

## What “readily accessible” and “legible” actually mean

Regulators expect more than a filing cabinet full of paper that technically exists. Records must be legible and in English, and any correction has to leave a traceable trail rather than overwriting the original entry.

“Readily accessible” means an inspector should be able to view or receive the required records promptly, not after a fortnight of searching through old drives. Courts and the Fair Work Ombudsman treat contemporaneous entries, records made at the time the work happened, as far stronger evidence than a dataset stitched together after the fact. A roster alone rarely proves what was actually worked and paid; you need the calculation trail behind it.

![workit HR recruitment, onboarding, HR, compliance, performance review, background screening, learning management](https://csuxjmfbwmkxiegfpljm.supabase.co/storage/v1/object/public/blog-images/organization-41420/1788752529966_Five-principles-for-audit-ready-records.jpeg)

Tax file numbers carry their own handling rules. The [OAIC’s Privacy (Tax File Number) Rule 2015](https://www.oaic.gov.au/privacy/the-privacy-act/tax-file-numbers/) requires secure storage and lawful disposal, so TFN data needs tighter access controls than a general employee file.

## Payroll, PAYG, super and STP obligations

Single Touch Payroll reporting is compulsory, but it’s a reporting channel, not a substitute for the records behind it. The [ATO](https://www.ato.gov.au/employers) still expects you to hold the supporting documentation that proves each STP submission was accurate.

That means keeping:

- TFN declarations for every employee
- PAYG withholding calculations and payment summaries
- STP report copies and reconciliation evidence
- Superannuation contribution receipts showing fund, amount and date

Retention runs five years for most of these, though super contribution records are timed from the contribution date rather than the reporting period. Build a weekly habit of reconciling your STP exports against your payroll ledger. Catching a mismatch after a week is a five-minute fix; catching it after a year is an audit.

## Where employers get caught out

Fair Work inspectors don’t jump straight to fines. Minor or first-time issues usually draw a contravention letter, a written prompt to fix the problem. Repeated or wilful breaches escalate to infringement notices or court action, where penalties scale up sharply.

The pitfalls that keep showing up:

- Aggregated pay figures with no visible calculation basis behind them
- No contemporaneous record, just a reconstructed spreadsheet built after a complaint
- Late or missing payslips, one of the most common infringement notice triggers

If you find a gap today, document it, fix the process, and tell affected employees before an inspector finds it for you. Businesses defending [back pay claims](https://workit.com.au/back-pay-explained-a-guide-for-australian-employers) with granular, contemporaneous records resolve them far faster than those relying on memory and rough estimates.

## A practical checklist to get audit ready

Break record keeping into a rhythm rather than a once a year scramble.

1. **Daily**: log hours, breaks and any allowance triggers at the time they happen.
2. **Weekly**: reconcile STP exports against your payroll ledger and check leave accruals.
3. **Monthly**: confirm super contributions have actually landed in the right fund, not just been processed.
4. **On termination**: finalise final pay, leave payouts, and store termination paperwork in the employee’s file immediately.

The Fair Work Ombudsman publishes free templates for time and wages records and payslips, use them as your baseline, then keep a small “inspection pack” of exported ledgers and leave records ready to hand over.

**Pro Tip:** _Run a quarterly spot check on five random employee files against your checklist. It takes twenty minutes and catches the gaps a full audit would take days to find._

## Digital record keeping and audit readiness

A spreadsheet survives until someone overwrites a cell. What you need is a system that stamps every entry with a time, keeps a visible calculation trail, and restricts who can see TFN and pay data.

- Time-stamped entries that can’t be silently edited
- Exportable calculation traces for allowances, overtime and penalty rates
- Role-based access so payroll data isn’t visible to the whole business
- Secure TFN storage that meets OAIC handling standards

The [AHRI legal guide to employee records](https://www.ahri.com.au/articles/legal-guide-to-employee-records) notes courts have rejected reconstructed datasets that require reconciliation across multiple systems, contemporaneous, exportable records win every time. A compliant HRIS that reconciles daily rather than at year end matches the ATO’s own operational advice on reducing retrospective compliance risk.

## What to do when someone asks to see the records

Employees are generally entitled to a copy of their own records, and inspectors expect production without unreasonable delay. Nominate one person, usually your payroll or HR lead, as the single point of contact for these requests, so nothing sits in someone’s inbox for a week.

Redact other employees’ data before handing over copies, and transfer files securely rather than emailing raw exports. If something’s missing, say so plainly, note when it will be fixed, and keep that communication on file. A documented gap handled honestly reads very differently to an inspector than a gap discovered mid-audit.

## Why most record-keeping failures aren’t malicious

Most businesses that fall foul of s535 aren’t trying to short-change staff, they’re relying on a signed contract and a rough spreadsheet, and assuming that counts as a record. It doesn’t. Inspectors and courts want to see how a figure was calculated, not just what the final number was.

![workit HR recruitment, onboarding, HR, compliance, performance review, background screening, learning management](https://csuxjmfbwmkxiegfpljm.supabase.co/storage/v1/object/public/blog-images/organization-41420/1788752608330_Why-most-record-keeping-failures-aren-t-malicious-overview-diagram.jpeg)

The compliance gap almost always sits in the export, not the intent. A business paying correctly but unable to produce a contemporaneous calculation trail is treated the same as one that underpaid deliberately, both fail the test. If your payroll process depends on someone’s memory of “how we usually calculate that allowance,” you already have a seven-year problem waiting to surface.

Run the quarterly file check mentioned earlier. It’s the cheapest insurance against a very expensive letter from the Fair Work Ombudsman.

> _— Stephen_

## Get audit ready without the spreadsheet chaos

There are HR software platforms built to address compliance challenges like time-stamped entries, exportable calculation traces, and secure role-based access to TFN and pay data, all in one platform. It replaces the patchwork of spreadsheets and disconnected systems that make seven-year record retention such a scramble when an inspector actually calls.

[![workit HR recruitment, onboarding, HR, compliance, performance review, background screening, learning management](https://csuxjmfbwmkxiegfpljm.supabase.co/storage/v1/object/public/blog-images/organization-41420/1782880458089_workit.jpg)](https://workit.com.au/contact?intent=demo)

Some HR software solutions offer all modules, from payroll integration to leave tracking to reporting, in a flat per-employee monthly price, often with local support to assist with compliance obligations. These systems aim to make onboarding efficient and keep records contemporaneous, making audit preparations more streamlined. If you want to see how it handles [Fair Work compliance and audit readiness](https://workit.com.au/how-an-hris-supports-fair-work-compliance-audit-readiness) for a business like yours, [book a demo](https://workit.com.au/demo-landing-page) and bring your trickiest record-keeping question with you.

## FAQ

### How long does an employer have to keep employee records in Australia?

Generally seven years under Fair Work Act s535 for time, wages, leave and agreement records, though many ATO-related tax and super records only need five years.

### What records need to be kept for seven years in Australia?

Time and wages records, leave and roster records, individual flexibility arrangements, and termination documentation all fall under the seven-year Fair Work retention rule.

### What are the main rules for record keeping in Australia?

Records must be made and kept for the required period, stay legible and in English, remain readily accessible to an inspector, and show a genuine calculation basis rather than a reconstruction after the fact.

### What happens if my business doesn’t keep proper employee records?

The Fair Work Ombudsman may issue a contravention letter for minor first-time issues, escalating to infringement notices or court action for repeated or wilful breaches.

### Does Single Touch Payroll replace the need for other records?

No. STP reporting is compulsory but doesn’t remove the obligation to keep supporting payroll, PAYG and superannuation records behind each submission.
